Terms of Service

Please read these Terms of Service ("Terms") carefully before using the DeckTrace mobile application ("App") operated by DeckTrace ("we", "us", "our").

1. Acceptance of Terms

By downloading, installing, or using DeckTrace, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Agreement Between You and DeckTrace

This agreement is between you and DeckTrace only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). DeckTrace, not Apple or Google, is solely responsible for the App and its content. Your use of the App must comply with the App Store or Google Play Terms of Service.

3. Description of Service

DeckTrace is a trading card portfolio tracker that allows users to:

  • Track the value of their trading card collections
  • Search for products and view pricing data from third-party marketplaces
  • Set price alerts and maintain watchlists
  • View historical portfolio value trends

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded or Android device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service or the Google Play Terms of Service (as applicable). You may not distribute, sublicense, lease, lend, or otherwise transfer the App to any third party. You may not copy (except as permitted by the license and Usage Rules), reverse-engineer, disassemble, decompile, or create derivative works of the App or any part thereof.

5. Account Registration

You must create an account to use DeckTrace. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity under your account

You must be at least 16 years old to create an account. If you are under 18, you must have permission from a parent or legal guardian.

6. Subscriptions & Payments

DeckTrace offers a free tier and a paid subscription ("DeckTrace Pro").

  • Payment is charged to your Apple ID or Google Play account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the rate of the selected plan
  • Subscriptions may be managed and auto-renewal may be turned off by going to your Account Settings in the App Store or Google Play Store after purchase
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription
  • Subscription prices are: Monthly: €4.99/month; Yearly: discounted annual rate (displayed in-app at time of purchase)
  • No refunds are provided for partial billing periods, except as required by applicable law or the respective app store's refund policy

7. Pricing Data Disclaimer

DeckTrace displays pricing information sourced from third-party marketplaces (including Cardmarket). This data is provided for informational purposes only.

  • We do not guarantee the accuracy, completeness, or timeliness of pricing data
  • Prices may fluctuate and may not reflect the actual transaction price
  • DeckTrace is not a marketplace — we do not facilitate buying or selling of trading cards
  • Investment decisions based on data shown in DeckTrace are made at your own risk
  • We are not liable for any financial loss resulting from reliance on pricing information displayed in the App

8. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App's infrastructure
  • Use automated scripts, bots, or scrapers to access the App
  • Circumvent any access restrictions or rate limits
  • Share your account credentials with third parties
  • Use the App to harass, abuse, or harm others

9. Intellectual Property

All content, trademarks, and technology in DeckTrace are owned by or licensed to us. Trading card names, images, and related trademarks belong to their respective owners (including but not limited to The Pokémon Company, Nintendo, and Bandai Namco). DeckTrace is not affiliated with, endorsed by, or sponsored by any trading card game publisher.

10. Account Deletion

You may delete your account at any time through the App's account settings. Upon deletion:

  • All your personal data, portfolio data, watchlist data, and value snapshots will be permanently removed
  • Active subscriptions must be cancelled separately through your App Store or Play Store settings
  • Account deletion is irreversible

11. Limitation of Liability

  • DeckTrace is provided "as is" and "as available" without warranties of any kind
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid for DeckTrace Pro in the 12 months preceding the claim
  • We are not responsible for downtime, data loss, or service interruptions

12. Maintenance and Support

DeckTrace is solely responsible for providing maintenance and support for the App, as required under applicable law. Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the App.

13. Warranty

DeckTrace is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App.

14. Product Claims

DeckTrace, not Apple or Google, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

15. Legal Compliance

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated as a "terrorist supporting" country, and that you are not listed on any government list of prohibited or restricted parties.

16. Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance, Apple will have the right to enforce these Terms against you. Google is likewise a third-party beneficiary where applicable.

17. Intellectual Property Disputes

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, DeckTrace, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

18. Modifications to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance. We will notify users of material changes through the App or via email.

19. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, without prior notice.

20. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the competent courts of the Netherlands.
